Should Hawaii Families Look Beyond Hawaii for a Dynasty Trust?

Hawaii has a long tradition of preserving family wealth, closely held businesses, and real estate across generations. Estate planning often reflects those values, with families seeking structures that provide continuity while protecting assets for children, grandchildren, and future descendants.

When considering a dynasty trust, however, many Hawaii families discover that the location of the trust does not necessarily need to match the location of the family. While Hawaii provides a well-established trust code, some families compare its laws with jurisdictions that have devoted decades to refining long-term trust administration.

Hawaii’s Dynasty Trust Laws

A dynasty trust allows assets to remain in trust for multiple generations rather than passing outright from one generation to the next. Keeping assets within the trust can provide continuity of management while helping preserve family wealth over an extended period.

Hawaii generally permits dynasty trusts with a maximum duration of 90 years. Although this provides meaningful planning opportunities, it is substantially shorter than the trust durations permitted by many states that have modernized their rule against perpetuities.

As a result, families establishing trusts intended to benefit generations well into the future often compare Hawaii’s framework with jurisdictions that permit significantly longer trust durations.

Trust Duration Is Only One Consideration

The maximum duration of a dynasty trust is easy to compare because it is expressed as a number of years. In practice, however, selecting a trust jurisdiction involves a much broader analysis.

Families frequently consider whether the state recognizes directed trusts, permits modifications to irrevocable trusts, provides meaningful privacy protections, and continues updating its trust laws as planning needs evolve. Those factors can become increasingly important as a trust matures and family circumstances change over time.

For many families, the governing jurisdiction is selected not because of a single statutory feature, but because of the overall legal environment that will shape the trust for decades to come.

Hawaii Compared to South Dakota

Hawaii and South Dakota approach trust law from very different perspectives.

Hawaii maintains a comprehensive trust code that serves the estate planning needs of its residents. South Dakota has taken a different path by continually refining its trust laws with long-term trust administration as a primary focus.

Today, South Dakota permits perpetual dynasty trusts and offers extensive privacy protections, broad quiet trust provisions, flexible trust modification statutes, and one of the country’s most developed trust administration industries. Those features have made South Dakota a frequent choice for families evaluating trusts expected to remain in existence for generations.

For Hawaii families, the comparison is often less about where they live and more about which jurisdiction offers the legal framework they want governing their family’s trust.

A Dynasty Trust Can Cross State Lines

One of the most common misconceptions about dynasty trusts is that they must be governed by the laws of the state where the trust creator resides.

In many cases, that simply is not true.

Families may continue living, working, and investing in Hawaii while establishing a trust under the laws of another jurisdiction if doing so better aligns with their long-term planning objectives. Taking the time to compare those options before a trust is established can provide greater flexibility for future generations.

Professional Guidance

Every family approaches dynasty trust planning from a different perspective. Some prioritize preserving a family business, while others focus on privacy, governance, or creating a structure capable of serving multiple generations.
