A trust is a dynamic legal vehicle because, in many ways, it is a blank slate. Most trusts are drafted to hold and manage assets for one or more beneficiaries. That assumption is so common that many people believe every trust must have at least one natural person who ultimately receives the trust’s benefits. Texas law, however, recognizes certain purpose trusts, which take a different approach. Rather than existing primarily for the benefit of an individual, a purpose trust exists to accomplish a defined objective. In these situations, the trust is designed not around who should receive the assets, but what those assets are intended to accomplish.
A purpose trust is established to fulfill a specific objective rather than to transfer financial benefits to beneficiaries. Like any other trust, it is the trustee’s responsibility to carry out the instructions contained in the trust agreement. That agreement defines the trust’s purpose, the trustee’s authority, how trust assets may be used, and the circumstances under which the trust will terminate. Because Texas has not adopted perpetual trusts, purpose trusts remain subject to the state’s rules limiting purpose trust duration to 300 years. The trust’s purpose must also be drafted with sufficient clarity that a trustee can administer it consistently with Texas law and the grantor’s intent.
The concept becomes easier to understand by looking at the kinds of problems a purpose trust is designed to solve. Some are created to care for pets after an owner’s death or to maintain family property that is intended to remain intact. Others are established to preserve artwork, historical collections, or family cemeteries that might otherwise be neglected if ownership passes to future generations without the resources necessary to maintain the property.
One of the most compelling uses of a purpose trust, however, is to advance a charitable objective without creating a traditional charitable organization. A grantor may wish to preserve a local landmark, maintain a community garden, care for a historic church property, or provide ongoing support for another narrowly defined public purpose. Rather than making a one-time gift with no assurance of how it will be used, a purpose trust can establish an ongoing legal structure that directs assets toward a specific objective over time. The trust becomes a mechanism for preserving intent, ensuring that the grantor’s wishes continue to guide how the assets are managed long after the grantor is gone.
Like any trust, a purpose trust should be drafted carefully. The stated purpose must be specific enough to guide administration while allowing sufficient flexibility to accommodate changing circumstances. Funding should be realistic and proportionate to the objective being accomplished. A trust established to care for a pet, for example, will have very different financial needs than one intended to preserve a historic property for three centuries. Careful drafting helps ensure the trustee has both the authority and the practical ability to fulfill the trust’s purpose.
Purpose trusts are a specialized planning tool, not a replacement for the core components of an estate plan such as revocable living trusts, dynasty trusts, or asset protection trusts. Instead, they solve a different kind of planning problem. Sometimes the question is not who should inherit an asset, but how a particular purpose can continue after the person who created it is gone.
Estate planning is often viewed as the process of deciding who receives property after death. Purpose trusts demonstrate that the question is sometimes much broader. For some families and charitable objectives, preserving a mission is just as important as transferring wealth. Texas purpose trusts provide a legal framework for carrying that mission forward, allowing carefully drafted instructions to guide the stewardship of assets long after the grantor is no longer here. When the objective is continuity of purpose rather than continuity of ownership, a purpose trust can become an effective and enduring part of a comprehensive estate plan.
