Most discussions around South Dakota trusts focus on dynasty trusts, domestic asset protection trusts, and long-term family wealth planning. South Dakota has developed one of the most sophisticated trust environments in the country, supported by both a modern statutory framework and a mature trust services industry. Together, they provide families with powerful tools for privacy, asset protection, governance, and long-term wealth management. What is discussed less frequently is how these same characteristics make South Dakota an attractive jurisdiction for certain state income tax planning strategies. One of the most notable examples is the Incomplete Gift Non-Grantor Trust, commonly known as an ING trust.

An ING trust is a highly specialized structure built to address a specific planning objective. In the right circumstances, it may allow a taxpayer to reduce exposure to state income taxes while retaining the flexibility associated with an incomplete gift. Because the strategy attempts to achieve multiple tax objectives simultaneously, ING trusts are among the most technically complex trust structures in modern planning. Their effectiveness depends heavily on trust drafting, administration, asset selection, and the grantor’s state of residence.

At a high level, an ING trust combines two distinct tax concepts. First, the transfer to the trust is structured as an incomplete gift, meaning the assets generally remain within the grantor’s taxable estate. Second, the trust is structured as a non-grantor trust, allowing it to be treated as a separate taxpayer for income tax purposes. The objective is to create a trust that maintains enough retained rights to prevent a completed gift while avoiding so much retained control that the trust is disregarded for income tax purposes. This balance is what makes the structure both powerful and technically demanding.

South Dakota’s role in this planning is not simply its lack of a state income tax. The trust must be administered somewhere, and the quality of that jurisdiction matters. South Dakota offers a well-developed trust industry, experienced fiduciaries, strong privacy protections, flexible governance provisions, and a legal framework built around sophisticated trust administration. An ING trust depends on proper ongoing administration, making the surrounding trust ecosystem just as important as the tax characteristics of the jurisdiction itself.

Unlike many other advanced trust strategies, ING trusts are generally not focused on estate tax reduction. Because the transfer is intentionally structured as an incomplete gift, the assets often remain part of the grantor’s taxable estate. The primary objective is state income tax planning. At the same time, the trust may benefit from many of the same South Dakota advantages that attract families to dynasty trusts and other long-term structures, including privacy protections, modern trust governance, and multi-generational planning flexibility.

The effectiveness of an ING trust ultimately depends on the grantor’s state of residence and the nature of the assets involved. Several states have challenged or limited the benefits of ING trust planning, with California being one of the most notable examples. In addition, certain assets may remain subject to taxation where they are physically located or where income is sourced. For that reason, ING trusts require careful analysis and should never be viewed as a simple solution for state income tax liabilities.

South Dakota ING trusts represent one of the more sophisticated applications of modern trust planning. They are not appropriate for every family, nor are they a substitute for comprehensive estate planning. In the right circumstances, however, they demonstrate how trust jurisdiction can influence outcomes far beyond traditional wealth transfer planning. When properly structured and administered, an ING trust may provide a framework for state income tax planning while operating within South Dakota’s broader trust and fiduciary ecosystem.
